Is Sports Arbitration The Way Forward?

Over the years, sport has turned into a multi-billion-dollar industry involving lucrative investments from all over the world. Therefore, it should not come off as a matter of surprise that sports also has become a subject of legal disputes across the globe. One of the major mechanism of dispute resolution in the field of sports has been arbitration, mainly thanks to the uniform practice and abundant, publicly-available case law of the Court of Arbitration for Sport (the “CAS”), based in Lausanne, Switzerland, colloquially referred to as the Supreme Court for sports disputes.

In our recent paper of the series on Sports Disputes titled “Time for evolution of sport adjudication in India: Is Sports Arbitration the way forward?”, we have aim to gauge the viability of sports arbitration in India. We have extensively laid down the global sports arbitration regime ranging from the nature of disputes adjudicated by the CAS to the jurisprudence adopted courts/tribunals in Sports Arbitration globally, and further ventured into ways in which the practice of sports arbitration can be encouraged within the Indian landscape in the long run, including the aspect of third-party litigation funding involving sports disputes in India.
